TERMS OF AGREEMENT

By paying the initial deposit and agreeing that this document has been read at the time of booking the client hereby agrees to all terms and conditions.

BOOKING POLICY

At the time of booking, a $100 non-refundable deposit is required to hold your date and time. Payment of the deposit acts as a binding agreement between the client and RIDDLE DIGITAL LLC (Shawn Riddle Photo).

PAYMENT POLICY

Deposit is for retainer of services and studio reservation fee and is NOT refundable after 24 hours of booking. Sessions are to be paid in full immediately after the session only by Credit card, cash, Paypal or Venmo.

LATE ARRIVAL

Session end times will can not be extended to accommodate late client arrival. If Shawn Riddle has the availability to extend the session the client may pay for additional time within business hours, but it is not a guarantee of availability.

CANCELLATION/RESCHEDULING POLICY

If you are unable to make your photo session all deposits will act as a cancellation fee and will cover the non-refundable studio reservation fee. If the session needs to be rescheduled within 24 hours of booking the session there is one complimentary reschedule. If for any reason after 24 hours of booking the session, there will be a $50 rescheduling fee will be added to your open invoice.

Any reschedule under 72 hours before session will be treated as a cancellation, and will result in forfeiture of deposit.

Location fees & permissions are the responsibility of Client; no refunds or rescheduling will be permitted due to permissions on day of session.

The photographer reserves the right to deny service to any client(s) who repeatedly have a history of cancellations. If Shawn Riddle cannot perform this contract due to fire or other casualties, strike, an act of God, or other cause beyond the control of the parties, or due to the photographer's illness or emergency, then the photographer shall return the deposit fee to the client but shall have no further liability concerning the contract.

TURNAROUND TIME

Turnaround time is 5 business days AFTER selecting your images, so please keep this in mind when booking your session if you have a deadline to meet.

Rush turnaround time is up to 48 hours and requires a payment of $15 per image in addition to any other session fees paid. Rush turnaround is not guaranteed to be available, and must be approved on the date of session.

If the client request additional edits outside of the original package, this may delay your turnaround time by 2 business days.

IMAGE POLICY

Following the shoot, your unedited proof images will be made available for viewing via online private gallery for selecting. You will be able to select all of the image you would like retouched; and send an invoice to cover any additional images after the # of images that are included in your session package.

The proof images are unedited, watermarked, and have no access to download or use. The photographer will reach out once to follow up with the creation of your list.

If you wish to have access to download RAW files for outside usage, that license fee is $100 per session, in addition to any session fees. Raw or unedited photos should not be shared on any social media services without the permission of the photographer.

MODEL RELEASE

This photography contract serves as a model release. The client grants the photographer the right to use all images and footage without restriction for advertising, portfolios, and other lawful purposes. The client waives the right to inspect any images produced using the images or footage from the events in this contract, and the right to restrict the use of the images or footage from the listed events by the photographer.

CREATIVE LICENSE

Images are edited at the photographer’s discretion, and delivered prints may not include all images shot. The photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographer’s artistic standards.

All photographs and footage are and shall remain the sole intellectual property of the photographer per the United States Copyright Laws. The Client hereby waives any rights to intellectual property ownership, monetization, or reproduction of the images and footage created by the Photographer, with exception of the terms of any formal written releases provided to the Client by the Photographer.

By paying the initial deposit and agreeing that this document has been read the photographer does grant the Client the right to print images for personal or family use. the photographer grants the client the right to publish the photographs on social media (Instagram, Twitter, Facebook, etc) and personal websites. If the client wishes to use images for commercial, multimedia advertising, sale, etc the photographer will provide the documentation and invoice for such matters. The Client may present this contract to photo printing companies if they request authorization from the Photographer.

ADDITIONAL PERSONS

We encourage you to bring only extra persons that are essential to the success of the shoot, such as makeup/hair stylist or assistants.

Anyone under the age of 17 must be accompanied by an adult. Small children should be left at home unless absolutely necessary, to prevent injuries.
